Terms
of Service Agreement
*PLEASE
READ THIS AGREEMENT CAREFULLY BEFORE ACCESSING THE SERVICE. BY ACCESSING
THE SERVICE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS BELOW. IF
YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU MAY NOT
ACCESS OR USE THE SERVICE.
The customer may only use
World South.Net internet access if the customer agrees to this
agreement.

Herein, World
South.Net will be referred to as World South.
01.
World South claims no control over the information by
equipment or software not provided by World South that may be
transmitted through its systems. Customer
understands that they or authorized users may access the
Internet through World South and customer further understands
that neither World South nor any of
World South's affiliates controls the Internet in any way, and
that all information and services offered by other parties are
made available by other parties not affiliated with World
South. World South is not responsible for any damages
incurred (i.e. equipment failure, service interruptions by
World South and loss of data resulting from delay, or
third-party litigation). |

02.
Customer understands that there are
unedited materials available via the Internet (i.e. sexually
explicit materials). Customer further understands that World
South does not operate or filter any of this information and
is not responsible for it in any way. Use of information
obtained by using the services provided by World South is at
the sole risk of the customer, including but not limited to:
possible virus infection of system or software. World South
does not claim any responsibility for the information obtained
via the services offered by World South. |

03.
Customer may not post, e-mail or
transmit any illegal programs (i.e. "warez",
"cracks", "serialz", viruses, software
that is not shareware, freeware, or slackware), any links to
your personal page or any other web site that may contain any
of the above mentioned materials or links to any of the above
mentioned, abusive, offensive, indecent, obscene,
pornographic, profane, unlawful information of any kind, or
otherwise objectionable information of any kind including any
transmissions constituting or encouraging conduct that would
constitute a criminal offense, give rise to civil liability,
or otherwise violate any local, state, federal or
international law, including without limitation the U.S.
export control laws and regulations and laws protecting
intellectual property including copyright, trademark, trade
secret, misappropriation and anti-dilution laws. No
threatening of bodily harm or property damage may will be
tolerated and will result in immediate account inactivation
without a refund. World South reserves the right to
cooperate with legal authorities and/or injured third parties
in the investigation of any suspected crime or civil wrong
doing. |

Customer may not upload or post: any
data that contains a virus or other malicious programs that
may be considered potentially harmful to others or distribute
in any way information or software that is protected by
copyright laws. |

Customer may not use World South
services to transmit any unsolicited commercial e-mail or
unsolicited bulk e-mail (SPAM). Facilitating unsolicited
commercial e-mail or unsolicited bulk e-mail, whether or not
that e-mail is commercial in nature, is prohibited and could
result in account inactivation without a refund. |

06.
World South offers Internet Access to each customer
with a dial-up account package. However, if customer is
idle for an extended period of time, World South reserves the
right to terminate the connection. If a connection is
terminated because of idleness, the customer may reconnect at
any time. If customer stays connected to the Internet
for an extended period of time without disconnection for any
purpose, said customer account may be considered a dedicated
usage account and subscriber will need to request an upgrade
to a dedicated connection package. (Dedicated usage is
usage exceeding your allowed hours per month.) |

07.World
South requires prompt payment for service charges. If customer
fails to pay for service charges for two consecutive weeks
after receiving service charge statement, services will be
suspended. Suspended accounts may be reactivated for a fee of
$10.00 + overdue charges. All returned checks will be charged
the maximum fee of $25.00. Customers choosing to pay for
service via credit card are billed automatically unless
notification is given 48 hours before
next payment is due. No invoices are sent to credit card
accounts. Invoices for non credit card accounts are sent via
World South.Net Email. |

08.
If customer wishes to terminate service
with World South, customer must notify World South before
the next payment due date (25th of the month –
for the next month) . World South
does not prorate for monthly access. The price is the same if
you have service for 31 days or 1 day. World South’s service
runs on a calendar month. Example Jan 1st to
Jan 31st not Jan
13th to Feb 12th. Customers not renewing
for the next month will be turned off on close of business on
the last working day of the month. |

09.
World South reserves the right to change terms, conditions,
rates, or services of dial-up packages at any time but will
notify 30 days in advance the entire customer
base.

10.
World South prohibits the use of multiple simultaneous
connections per user. World South reserves the right to
terminate such connections and pursue further action (i.e.
termination of account without refund). Use of software
or any device (ping or "keep alive" program) that
would allow your account to stay logged on while you are not
actively using World South services or use the account for the
purpose of operating a server of any type is prohibited.
All subscribers that are logged in and have no activity for at
least 2 hours will be disconnected from the service.
Installation of 'auto-responders', 'cancel-bots', or similar
automated or manual routines which generate excessive amounts
of net traffic or disrupt net newsgroups or email use by
others is strictly prohibited. |

11.
World South reserves the right to refuse service to any
persons or businesses and may terminate customer
accounts at World South's own discretion. |

12.
World South makes no warranties, expressed or implied,
regarding services provided. |

|
13.
This agreement may be terminated by customer or World South at
any time without prior notice and without cause.. |

|
14.
World South is not responsible for long distance charges. |

|
15.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS
AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER
EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF
TITLE, NONINFRINGEMENT, IMPLIED WARRANTIES OF MERCHANTABILITY
OR FITNESS FOR A PARTICULAR PURPOSE OR ANY WARRANTIES ARISING
FROM COURSE OF DEALING OR USAGE OF TRADE. NO ADVICE OR
INFORMATION GIVEN BY World South, ITS AFFILIATES, ITS
LICENSERS, ITS CONTRACTORS OR THEIR RESPECTIVE EMPLOYEES SHALL
CREATE A WARRANTY. NEITHER World South NOR ITS AFFILIATES, ITS
LICENSERS, ITS CONTRACTORS OR THEIR RESPECTIVE EMPLOYEES
WARRANTS THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE
OR THAT ANY INFORMATION, SOFTWARE OR OTHER MATERIAL ACCESSIBLE
ON THE SERVICE IS FREE OF VIRUSES, CANCELBOTS, WORMS, TROJAN
HORSES OR OTHER HARMFUL COMPONENTS |

16.
If User is dissatisfied with the Service or with any terms,
conditions, rules, policies, guidelines or practices of World
South in operating the Service, User's sole and exclusive
remedy is to discontinue using the Service. |

17.
UNDER NO CIRCUMSTANCES SHALL World South, ITS AFFILIATES, ITS
LICENSERS, ITS CONTRACTORS OR THEIR RESPECTIVE EMPLOYEES BE
LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE
OR CONSEQUENTIAL DAMAGES THAT RESULT IN ANY WAY FROM USER'S
USE OF OR INABILITY TO USE THE SERVICE OR TO ACCESS THE
INTERNET OR ANY PART THEREOF, OR USER'S RELIANCE ON OR USE OF
INFORMATION, SERVICES OR MERCHANDISE PROVIDED ON OR THROUGH
THE SERVICE, OR THAT RESULT FROM MISTAKES, OMISSIONS,
INTERRUPTIONS, DELETION OF FILES, ERRORS, DEFECTS, DELAYS IN
OPERATION OR TRANSMISSION, ANY FAILURE OF PERFORMANCE,
COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR
DESTRUCTION OR UNAUTHORIZED ACCESS TO ALTERATION OF OR USE OF
USER'S ACCOUNT, WHETHER FOR BREACH OF CONTRACT, NEGLIGENCE OR
UNDER ANY OTHER CAUSE OF ACTION. IN THE EVENT World South IS
FOUND LIABLE UNDER ANY CIRCUMSTANCE UNDER THE TERMS OF THIS
AGREEMENT, World South's LIABILITY SHALL BE LIMITED TO
THE UNUSED BALANCE OF USER'S SUBSCRIPTION PAYMENT PRO-RATED TO
REFLECT THE CURRENT TERM. |
